TERMS AND CONDITIONS
OVERVIEW
This website is operated by Jenny Halfina, B.Sc. Throughout these Terms and Conditions, the terms “we”, “us”, and “our” refer to Jenny Halfina, B.Sc. and MaxOut.
By visiting our website, booking a class, or purchasing a product or service, you agree to these Terms and Conditions. These Terms apply to all users of our website and to all customers who book or use our services.
Please read these Terms carefully. If you do not agree to these Terms, you may not use our website or our services.
We reserve the right to update or modify these Terms at any time. The current version is available on our website.
SECTION 1
ONLINE BOOKINGS AND USE
Our services include, in particular, workouts, classes, training sessions, single tickets, and multi-class passes.
Bookings are made online through our website or the designated booking systems. Complete and accurate information is required for all bookings.
Customers agree to use our services only in a lawful and appropriate manner. Any misuse of the website, booking system, or our services is prohibited.
SECTION 2
SERVICES, PRICES, AND PAYMENT
All prices are displayed on the website or in the booking system. Prices are subject to change.
Payment is made using the available payment methods. A booking becomes binding only after successful payment or confirmation by us.
We reserve the right to modify, reschedule, or discontinue classes, prices, dates, or services if necessary.
SECTION 3
CANCELLATION BY CUSTOMERS
A booked class may be cancelled free of charge up to 12 hours before the start of the class. In this case, the booked session will automatically be credited back to the respective customer account.
Cancellations made less than 12 hours before the start of the class cannot be accepted. In this case, there is no entitlement to a refund, replacement class, or credit.
This also applies in cases of short-notice illness, personal reasons, or failure to attend.
Voluntary goodwill decisions in individual cases remain expressly reserved.
SECTION 4
CANCELLATION BY US
We reserve the right to cancel or reschedule classes for important reasons. These include, in particular, illness, adverse weather conditions, safety reasons, insufficient participant numbers, or other unforeseen circumstances.
If a class is cancelled by us, the booked session will automatically be credited back to the respective customer account. No further compensation can be claimed.
SECTION 5
PASSES, SINGLE TICKETS, AND CREDITS
Single tickets entitle the holder to participate in one booked class.
Multi-class passes, especially 5-class passes, may be used for multiple classes. Unused sessions remain stored in the respective customer account unless another validity period is specified.
5-class passes are generally non-refundable. A booked session from a pass will only be credited back if the cancellation is made at least 12 hours before the start of the class.
In the event of a later cancellation, short-notice illness, or failure to attend, the booked session will be forfeited.
SECTION 6
RIGHT OF WITHDRAWAL AND REFUNDS
Consumers generally have a statutory right of withdrawal of 14 days from the conclusion of an online contract, unless a legal exception applies.
If services have already been used within this period, an appropriate amount for the services already provided may be retained.
Once the booked service has been fully provided, there is no entitlement to a refund, insofar as this is legally permissible.
Statutory exceptions to the right of withdrawal remain unaffected. This applies in particular to services linked to a specific date or period where no statutory right of withdrawal exists.
SECTION 7
HEALTH AND PARTICIPATION
Participation in our classes is at the customer's own responsibility.
Customers confirm that they are physically able to participate in the training. In the case of health concerns, injuries, pregnancy, or uncertainty, medical advice should be sought before participating.
We accept no liability for health-related damages resulting from incorrect self-assessment, pre-existing medical conditions, or improper execution of exercises, to the extent permitted by law.
SECTION 8
LIABILITY
We strive to provide our services carefully and professionally.
Liability for slight negligence, indirect damages, loss of profits, or consequential damages is excluded to the extent permitted by law.
We accept no liability for personal belongings, valuables, or items brought to our classes.
SECTION 9
INFORMATION ON THE WEBSITE
We make every effort to keep all information on our website accurate and up to date. Nevertheless, errors, changes, or inaccuracies may occur.
We reserve the right to change content, prices, class schedules, and offers at any time.
SECTION 10
THIRD-PARTY PROVIDERS AND BOOKING SYSTEMS
Our website or booking system may use third-party services, such as payment providers, booking platforms, or hosting providers.
We accept no responsibility for the content, technical availability, or services of these third parties, to the extent permitted by law.
SECTION 11
PERSONAL DATA
The processing of personal data is carried out in accordance with our Privacy Policy.
Customers undertake to provide complete and accurate information when making bookings and payments.
SECTION 12
PROHIBITED USE
The use of our website or services for illegal purposes, abusive bookings, false information, technical attacks, spam, fraud, or the infringement of third-party rights is prohibited.
In the event of violations, we reserve the right to reject bookings, suspend accounts, or terminate access to our services.
SECTION 13
SEVERABILITY CLAUSE
Should any provision of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
SECTION 14
GOVERNING LAW
The laws of the Republic of Austria shall apply.
